SGBV: Baba Ijesha Sent Back To Prison As Lagos State Files Fresh Charges

 




Court Denies Baba Ijesha Fresh Bail Application, As Upper Court Files Fresh Case Against Him.



Nollywood actor, Olanrewaju Omiyinka, alias Baba Ijesha, who arraigned in a Magistrate court in Yaba yesterday Wednesday June 16 2021 following charges on rape against him has been denied bail and further sent back to jail following fresh charges against him, this time filed by the Lagos state government. 


MediaOrchid recalls that though Baba Ijesha was granted bail in May as a result of the industrial action by JUSUN and failing to meet bail conditions was kept in custody. Upon resumption of the court, he was arraigned yesterday on charges of 'rape, sexual assault, and abuse of a minor.'

Baba Ijesha faced charges on indecent treatment of a child, defilement of a child, sexual assault by penetration, attempted sexual assault by penetration and sexual assault – which contravenes Sections 135, 137, 261, 202, 262 and 263 of the Lagos State Criminal Law 2015.


Shockingly Baba Ijesha pleaded not guilty to the charges as presented by the court which also led S.A Adebesin, to reveal that a case  had been filed before the high court in the state. 


This information prompted Omiyinka's lawyer, Kayode Olabiran to make a fresh application for Baba Ijesha's bail. 


The Magistrate Nwaka, declined the request asking for bail on the ground that the Lagos State Ministry of Justice had already filed charges before a high court and had also directed that the defendant be given medical attention stressing on the fact that Baba Ijesha appeared 'pale' during his appearance. The matter was adjourned for July 13. 


“ This is a situation of lack of jurisdiction because once a case is filed at an upper court, the lower court, being the magistrate in this case, ceases to have jurisdiction over the same matter. I have carefully considered the application of the counsel to the defendant seeking bail for the defendant and the opposition by the counsel from the DPP.


“ Since there are indications that the matter is before the high court and the defendant will appear before the court, no bail can be given. The defendant must be accorded full medical attention by the authorities pending his arraignment at the high court.”
