Court Strikes Out Suit Challenging Fubara's Legitimacy.

A Federal High Court sitting in Abuja has struck out the suit filed by Doctor Farah Dagogo challenging the legitimacy of the candidate of the Peoples Democratic Party (PDP), Amaopusenibo Siminialayi Fubara.
According to the court ruling, Farah Dagogo only purchased the party Nomination and Expression of interest forms but did not undergo any screening to become an aspirant of the party and therefore lacked the locus standi to challenge the Party's Primaries.
Recall that the embattled Dagogo months ago dragged the Peoples Democratic Party (PDP) and the Independent National Electoral Commission (INEC) to court over his alleged exclusion from the list of governorship aspirants in the State.
Dagogo in a motion on notice filed at the Federal High Court, Abuja, sought an order of interlocutory injunction restraining the PDP from using any list of aspirants without his name to conduct the May 26 primary election pending the hearing and determination of the substantive suit.
The federal lawmaker is also sought an order restraining INEC from accepting any candidate who might emerge from the primary election conducted without his participation.
The six lawyers who filed the action on behalf of Dagogo are ; B.A. Adegbie, M. Dayi, A.M. Idoghor, H. Amrurhobo, Dickson Sofiyegha and Erica Akpofure.
Dagogo, though a serving member of the House of Representatives, representing the Degema-Bonny federal constituency was arrested, charged to court, and initially detained in police custody. He stood trial on two counts of "conspiracy to felony and cultism" in a State High Court, but pleaded not guilty to the charges and had yet to be granted bail.
Hon. Dagogo was remanded in a correctional facility where he spent 62 days after which a Rivers High Court sitting in Port Harcourt granted him bail on June 28 2022.
